Acceptable Use Policy
This AUP is part of the Business Terms of Service (in dashboard, app.torismic.com), the Partner/Reseller Agreement (available in the Partner dashboard, app.torismic.com), the Hardware Terms, and the Hardware Lease Terms. It applies to all business users of Torismic, including employees and resellers. Capitalized terms have the meanings in the Terms.
1. General Prohibitions
You may not:
- use Torismic for any unlawful purpose or to process illegal transactions;
- tamper with Torismic hardware or software (purchased or leased) — access, modify, root, jailbreak, flash, decompile, disassemble, reverse-engineer, or circumvent protections on Torismic software or firmware, or remove Torismic device management (see Terms §10.3A, Hardware Terms §6 and, for leased devices, the Hardware Lease Terms; this may violate laws such as 18 U.S.C. § 1030 and 17 U.S.C. § 1201);
- share credentials or PINs with unauthorized users or allow unauthorized access;
- resell, sublicense, white-label, or redistribute the Services except as an authorized reseller under the Partner/Reseller Agreement (Torismic brand only);
- disrupt, overload, probe, or attack the platform, or test its security without written permission;
- upload or transmit malicious code, or use the platform for spam or phishing;
- scrape or harvest data by automated means;
- impersonate any person or business, or misrepresent your identity or business information; or
- facilitate money laundering, terrorist financing, fraud, or sanctions evasion.
2. Prohibited and Restricted Business Types
Torismic may not be used by businesses engaged in the following. This list reflects card-network rules and approved payment processors' requirements and may be updated; your processor's prohibited/restricted list also applies and controls if stricter.
Prohibited:
- illegal drugs, controlled substances, or drug paraphernalia, and marijuana/cannabis businesses (illegal under federal law even where state-legal);
- adult content, escort services, or pornography;
- multi-level marketing, pyramid, or Ponzi schemes;
- counterfeit, stolen, or unauthorized replica goods;
- businesses lacking licenses required in their jurisdiction;
- any person or entity on OFAC or other U.S. sanctions/restricted-party lists.
Restricted (only if properly licensed and approved in writing by Torismic and your processor):
- firearms, ammunition, explosives, or weapons;
- gambling, lotteries, or games of chance;
- cryptocurrency-related businesses;
- payday or high-interest lending, and debt collection;
- telemarketing/outbound telephone solicitation;
- tobacco, e-cigarettes, vaping, hemp-derived CBD products.
If you are unsure whether your business qualifies, contact support@torismic.com before signing up.
3. Payment Processing Rules
When using payment-processing features, you may not:
- split transactions to evade limits or reporting thresholds;
- process transactions for another business or entity (factoring/laundering);
- issue refunds to a different payment method than the original, except as card-network rules allow;
- run personal (non-business) transactions through your terminal;
- process transactions without genuine goods/services, or artificially inflate volume;
- provide cash advances disguised as purchases; or
- knowingly accept stolen or fraudulent cards.
You are responsible for chargebacks, disputes, and processor/card-network fines on your account (Terms §6.4). You must maintain a backup method of accepting payments (Terms §15.3A).
4. Employee Data Rules
If you use employee-management features (time clock, PINs, scheduling), you will: use them only for legitimate, disclosed business purposes; give employees any notices required by law (including California CCPA notices to employees); not conduct surveillance beyond what is necessary and disclosed; promptly deactivate access when employment ends; protect PINs, time records, and performance data; and comply with wage-and-hour and other employment laws. Torismic time records are a tool; you are responsible for accurate payroll records.
5. Customer Data, Profiles & Messaging Rules
When you receive customer information through Torismic (including the copy of a customer's universal profile you receive when you scan the QR code the customer shows from their Torismic profile), you will:
- use it only to serve that customer, keep your records, run your own loyalty program, and send messages the customer agreed to;
- not sell it, not share it with any other business (including other Torismic merchants), and not try to learn about the customer's activity at other businesses;
- give required notices at collection and obtain required consents;
- honor opt-outs and deletion requests received directly;
- send marketing push notifications only to customers who have selected you as a favorite (the app enforces this), and use operational notices (e.g., ready for pickup, appointment reminders, estimates/invoices) only for genuine transactional purposes — never to disguise marketing;
- not send Torismic profile invitations, or any text, email, or other message about the Torismic universal profile, from your own phone, email, or messaging service — invitations go only through the invitation button on the Torismic platform — and invite only people you have a relationship with and any required permission to contact;
- when you use information from your own CRM (information your customers gave you directly) with your own customers, including marketing through your own channels, do so subject to applicable law and all applicable regulations — that use is your sole responsibility, and Torismic is not responsible for what you send to your own customers;
- send marketing texts only with prior express written consent and marketing email only in compliance with CAN-SPAM; and
- comply with industry rules for estimates, invoices, and work authorizations you send for customer approval (e.g., California Automotive Repair Act requirements).
5A. Gift Cards and Your Own Loyalty Program
If you sell gift cards or run your own loyalty program through Torismic, you are the issuer and are solely responsible for your terms and for complying with federal and state law (including the federal CARD Act/Regulation E gift-card rules and state rules on expiration, fees, cash redemption — e.g., California requires cash redemption of balances under $10 — and unclaimed property). Settings Torismic provides are configurable tools; use them lawfully and consult your own attorney. Torismic is not responsible for your gift-card or loyalty terms or for customer balances if your business closes.
5B. Torismic Rewards (Participating Businesses)
If you honor Torismic Coupons, you must follow the Program Terms §10: apply them only as discounts at your regular prices; no surcharges; no cash, change, or cash equivalents for coupons; restore coupons only through Torismic; and never collude with customers to manufacture visits, purchases, or redemptions.
6. Reseller Rules
Resellers must also follow the Partner/Reseller Agreement, including: Torismic brand only (no white label); no accepting terms on a merchant's behalf or varying Torismic's terms or pricing; no false earnings, pricing, or compliance claims; and no activating merchants in prohibited business types. Resellers that lease Torismic devices to merchants under their own lease terms must follow Partner/Reseller Agreement Section 6A.
7. Enforcement
For ordinary violations, we will give notice and an opportunity to cure within 10 days, where practicable and lawful, before suspending or terminating (Terms, Sections 18.2 and 18.4). For serious violations (fraud, illegal activity, payment abuse, or tampering), or where notice would create or worsen a security risk, we may suspend or terminate immediately. Termination for a violation is without refund (Terms, Section 18.5). Enforcement may also include device locking (for tampering, for purchased and leased devices alike, under Hardware Terms §6.3 and the Hardware Lease Terms §11; this is not a lock for subscription non-payment), clawback or offset of commissions tied to the violation (including commissions already paid, consistent with Partner/Reseller Agreement Section 4.4), and, for serious violations (fraud, illegal activity, payment abuse), reporting to processors, card networks, or law enforcement. We may monitor for compliance and, on suspicion of abuse, temporarily suspend features pending investigation.
Zero tolerance for tampering. Tampering with, reverse-engineering, or bypassing any protection on Torismic hardware, software, or firmware is prohibited and may result in immediate termination and legal action.
8. Changes
We may update this AUP (e.g., to track processor/card-network requirements). We will post the current version with its effective date and handle material changes under the two-step notice-and-acceptance process in the Terms §22.
