Consumer Terms (Customer App)
Version 1.0 · Effective November 4, 2026
| Version | 1.0 |
| Effective Date | November 4, 2026 |
| Applies to | Individual consumers using the Torismic customer app (U.S. only) |
Torismic Consumer Terms
KEY POINTS: (1) PLEASE READ SECTION 13. IT REQUIRES MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL ARBITRATION AND WAIVES CLASS ACTIONS AND JURY TRIALS. YOU MAY OPT OUT WITHIN 30 DAYS (SECTION 13.7). (2) Texts, emails, and other messages you get from a Business are that Business's responsibility, not Torismic's — reply STOP, unsubscribe, or contact the Business to stop them (Section 7.5). (3) Torismic itself sends you only service and account emails (plus a profile invitation email if a Business invites you through the Torismic platform); Torismic never texts you and never emails you on a Business's behalf for anything else (Section 7.4A).
1. Agreement and Eligibility
1.1 These Consumer Terms ("Consumer Terms") are an agreement between you and Torismic LLC
("Torismic," "we," "us"), a Nevada limited liability company, for your use of the
Torismic customer app and consumer features (the "App"). By creating an account or using the
App, you agree to these Consumer Terms and the Torismic Rewards Program Terms
(/rewards-terms) (the "Program Terms") if you participate in the Torismic Rewards Program, and you acknowledge the Privacy Policy (/privacy).
1.2 Age. You must be at least 18 years old to create an account. The App is not directed to children under 13, and we do not knowingly collect personal information from them; if we learn we have, we will delete it.
1.3 United States only. The App is offered only to residents of the United States.
1.4 One account per person. Accounts are personal and may not be shared or transferred.
2. What the App Does
The App lets you interact with businesses that use Torismic ("Businesses"). Today it lets you:
- keep one universal Torismic profile that you can share with the Businesses you choose (Section 3);
- join each Business's own loyalty program — each Business sets its own program rules and rewards, and your points for that program are tracked on your universal profile;
- receive and redeem Torismic Rewards — points and coupons issued by Torismic (not by a
Business), with the coupon discount funded by the participating Business (Program Terms) — at participating Businesses, under the Torismic Rewards Program Terms
(
/rewards-terms); Torismic Points are separate from each Business's own loyalty points; - book and manage appointments (e.g., salon, pet grooming, automotive);
- keep profiles for things a Business services for you (e.g., pets, vehicles);
- review and approve or decline estimates, invoices, and scope-of-work items a Business sends you (Section 5); and
- receive receipts, operational notices (e.g., "your pet is ready for pickup"), and marketing you have chosen to receive (Section 7).
The App is free to download and use.
Planned features. We may later add features, such as a Discover page to help you find nearby Businesses. Any such feature will be described in these Consumer Terms and the Privacy Policy when it launches, and any location-based feature will use your device location only if you turn on location services for the App. Nothing in these Consumer Terms promises that a planned feature will be offered.
3. Your Universal Profile and How Businesses See It
3.0 How a profile is created. A universal Torismic profile is created only when you accept a Torismic profile invitation (an email from Torismic, never a text message, sent when a Business invites you using the invitation button on the Torismic platform; Businesses may not send profile invitations from their own phone, email, or messaging channels) or sign up in the App yourself, and opt in. If you never opt in, a Business may still keep its own private customer record about you in its own Torismic CRM; that record belongs to that Business, is handled under the Business's own privacy practices, is never added to a Torismic profile, and is never shared with or visible to any other Business.
3.1 One profile, controlled by you. Your universal Torismic profile (your name, contact details, and the profile items you add, such as pets and vehicles) is maintained by Torismic for you. You own and control your profile; no Business owns it.
3.2 A Business sees you only after it scans your membership QR code. A Business cannot find, search for, or view your profile until it scans the Torismic QR code you show from your profile in the App (or you take another clear connection step we describe in the App). Until then, the Business has no view of you, and each Business's customer list is isolated from every other Business's.
3.3 What is shared when a Business scans your membership QR code. When a Business scans the QR code you show, the App shows you what will be shared, and the Business receives a copy of: your name, phone and/or email, profile photo (if any), and the pet/vehicle profiles you choose to share for that visit, but not your activity at other Businesses. The Business also creates its own records of your visits and purchases with it (e.g., service history, invoices, its loyalty points).
3.4 Visit-access toggle. For each connected Business, you can turn "Allow access on visit" on or off in App → Settings → Privacy. When it is off, that Business will not receive updates to your profile or automatically recognize you on later visits until it scans your membership QR code again or you turn it back on.
3.5 No cross-business visibility. A Business never sees your records, purchases, loyalty points, or invoices at another Business, and Torismic does not share one Business's records about you with another Business. A previous owner's records are never shown to a new owner of the same item (e.g., a used vehicle or rehomed pet).
3.6 What a Business may do with its copy. Each Business is responsible for its copy and its own records about you, and uses them under its own privacy practices and applicable law — for example, to serve you, keep service and tax records, run its loyalty program, and send you messages you have agreed to. Our Acceptable Use Policy prohibits Businesses from selling your information or sharing it with other Businesses.
3.7 If you are disconnected or delete your account. If you turn off a Business's access, it stops receiving updates to your profile. When the Business disconnects you, or you disconnect from the Business (or delete your profile), the Business's copy of your records (the profile information it received from you through QR scans) is removed and it stops receiving updates. Information the Business collected or kept itself is handled under its own policies (Section 3.8). If you delete your Torismic account, we delete your universal profile as described in the Privacy Policy, and you contact each Business directly, per location, to request deletion of the information it holds; each Business handles the information it holds itself under its own legal obligations.
3.8 If a Business leaves Torismic. If a Business cancels its Torismic subscription, Torismic does not give that Business a copy or export of the profile information it received from you through QR scans; that information is kept with the Business's other stored records for 90 days after its subscription ends without renewal (access is restored if the Business renews within that time) and then deleted (Privacy Policy, Section 9). Your own universal Torismic profile is not affected. However, any information about you that the Business collected or kept itself — for example, outside Torismic, or that it recorded or exported earlier with your consent — is the Business's responsibility and is governed by the Business's own privacy policy and legal obligations, not by Torismic. Torismic is not responsible for it. To ask about that information, contact the Business.
4. Your Relationship Is With the Businesses
4.1 Businesses are responsible for their own products, services, bookings, pricing, estimates and invoices, loyalty programs and rewards, refunds, gift cards, messages, and their handling of the information in their copy of your data.
4.2 Torismic provides the technology platform and is not a party to your purchases, estimates, approvals, or other dealings with a Business and is not responsible for a Business's goods, services, or conduct.
4.3 Card and other payments you make to a Business are processed by that Business's payment processor; Torismic does not receive or hold your payments. Torismic Rewards are not a payment method — they are Torismic Points and Torismic Coupons, and a Torismic Coupon reduces the price you pay (Program Terms). An expired coupon stays visible in your profile's Rewards history, marked as expired with its expiration date, but can no longer be redeemed (Program Terms, Section 6.1.1). You may tell others about Torismic, but Torismic does not offer any reward, bonus, points, or other incentive for referrals.
5. Estimates, Invoices, and Approvals
5.1 Businesses may send you estimates, invoices, scope-of-work items, or change requests (for example, additional auto repairs) for you to approve or decline in the App.
5.2 The approval is between you and the Business. When you tap approve or decline, the App records and sends your choice to the Business. The terms of the work, price, warranty, and any dispute are between you and the Business. Torismic is not a party and does not guarantee the work or the price.
5.3 Electronic records and signatures. By using approvals, you agree to receive these documents electronically and agree that tapping Approve is your electronic signature with the same effect as a handwritten signature (E-SIGN Act; Uniform Electronic Transactions Act as adopted in your state). You may ask the Business for a paper copy, and you can view, download, or save approved documents in the App. You may withdraw consent to electronic records by contacting the Business and Torismic; this does not affect approvals already given. To use approvals you need a supported device and the current App version.
5.4 Some industries have special rules (for example, California requires auto repair shops to give written estimates and obtain authorization before work). Businesses are responsible for complying with those rules.
6. Your Account and Conduct
Keep your login secure and your information accurate. You may not: commit fraud or impersonate anyone; create multiple accounts; manufacture visits or purchases; scrape, reverse-engineer, or interfere with the App; harass Businesses or their staff; post unlawful or infringing content; or use the App unlawfully. Content you submit (e.g., reviews, pet photos) must be yours to share, and you grant Torismic and connected Businesses a license to use it to operate the App.
7. Communications and Notifications
7.1 Service and operational messages. Torismic may email you service and account messages (Section 7.4A). Businesses you have transacted with may send you in-app operational notifications — for example, booking confirmations and reminders, receipts, estimates and invoices awaiting approval, and status updates (e.g., "your pet is ready for pickup").
7.2 Favorites and marketing push notifications. You may choose favorite Businesses. Only your favorites may send you marketing or promotional push notifications through the App. You can change favorites, or turn off marketing push entirely, at any time in the App or in your device settings. Torismic may send you Torismic Rewards Program-related promotional notifications if you allow them.
7.3 Email. Torismic's own emails are described in Section 7.4A. Emails from a Business are covered by Section 7.5.
7.4 Text messages. Torismic does not send you text messages, and never texts you on a Business's behalf. Any text you receive from a Business comes from that Business's own phone or messaging service (Section 7.5).
7.4A MESSAGES FROM TORISMIC vs. MESSAGES FROM BUSINESSES.
- From Torismic: only service and account emails about your Torismic account and the App — for example, sign-in and security notices, account changes, changes to our terms, and notices about your Torismic Rewards — plus, if you allow them, in-App notifications about Torismic Rewards (Section 7.2), and a profile invitation email if a Business invites you through the invitation button on the Torismic platform (Section 3.0). Other than that invitation email, Torismic never sends emails or texts on a Business's behalf. Torismic does not send its own promotional emails at launch. Service and account emails are separate from any promotional email; if that changes later, any Torismic promotional emails would go only to a separate opt-in list with an unsubscribe link (CAN-SPAM).
- From Businesses: inside the App, push notifications only (marketing push only from your favorites; operational notices from Businesses you have transacted with). Anything else from a Business — texts, emails, or calls — comes from the Business's own phone, email, or messaging service, outside Torismic, and is the Business's responsibility (Section 7.5). Businesses may not use their own channels to send Torismic profile invitations or other messages about your Torismic profile.
7.5 MESSAGES FROM BUSINESSES ARE THE BUSINESS'S RESPONSIBILITY — NOT TORISMIC'S. If a Business you interacted with uses your phone number or email address to send you any marketing text, email, or other message, that message is the Business's own communication and the Business's responsibility, not Torismic's. Those messages are sent from the Business's own phone, email, or messaging service, outside Torismic; Torismic does not write, control, review, or send them. To stop them, reply STOP to a text, use the unsubscribe link in an email, or contact the Business directly. Complaints about those messages should go to the Business. When a Business uses information from its own CRM (information you gave that Business directly) with its own customers, including marketing through its own channels, that use is the Business's sole responsibility, subject to applicable law, and the Business must follow all applicable laws and regulations. Torismic is not responsible for a Business's messaging practices or for what a Business sends its own customers through its own channels.
7.6 Information you give a Business stays with that Business. Information collected when you interact with a Business (for example, when it scans the QR code you show, booking, buying, or approving an invoice) — including your phone number and email address — is stored with that Business's records, and the Business's use of it for its own purposes, including sending you messages, is governed by the Business's own privacy policy, not by Torismic's. It is never shared with other Businesses, and it is not handed to a Business that leaves Torismic (Section 3.8).
8. Privacy
How we handle your information — including the categories collected, your California and other
state privacy rights, the "Do Not Sell or Share" choice, and the Notice of Financial Incentive
for the Torismic Rewards Program — is described in the Privacy Policy (/privacy). Where a request concerns
data in a Business's copy or its own records, contact that Business directly; it is
responsible for its copy.
9. Termination
You may delete your account at any time in App → Settings → Account or by contacting support. We may suspend or close accounts that violate these Consumer Terms or the Program Terms, or after 24 months of account inactivity (no qualifying earn or redemption), with at least 30 days' notice by email or in-app. Deleting an account affects Torismic Points and Torismic Rewards as stated in the Program Terms.
10. Mobile App Stores
If you downloaded the App from Apple's App Store or Google Play, these Consumer Terms are between you and Torismic, not Apple or Google. Apple and its subsidiaries are third-party beneficiaries of these Consumer Terms with respect to use of the App on Apple devices and may enforce them; Apple has no obligation to provide support or warranty for the App, and Torismic (not Apple) is responsible for addressing claims relating to the App. Your use must also comply with the applicable app-store terms.
11. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE EXTENT PERMITTED BY LAW, TORISMIC DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TORISMIC IS NOT RESPONSIBLE FOR THE ACTS, OMISSIONS, PRODUCTS, OR SERVICES OF BUSINESSES. Some states do not allow these disclaimers, so they may not apply to you.
12. Limitation of Liability
12.1 EXCLUDED DAMAGES. TO THE EXTENT PERMITTED BY LAW, TORISMIC IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF THESE CONSUMER TERMS, THE PROGRAM TERMS, OR THE APP.
12.2 CAP. TO THE EXTENT PERMITTED BY LAW, TORISMIC'S TOTAL LIABILITY ARISING OUT OF THESE CONSUMER TERMS, THE PROGRAM TERMS, OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TORISMIC IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) USD $100.
12.3 CARVE-OUTS. SECTIONS 12.1 AND 12.2 DO NOT APPLY TO: (A) LIABILITY ARISING FROM A DATA BREACH OR TORISMIC'S FAILURE TO MAINTAIN REASONABLE SECURITY OF YOUR PERSONAL INFORMATION; (B) TORISMIC'S WILLFUL MISCONDUCT, GROSS NEGLIGENCE, OR FRAUD; OR (C) ANY LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW. Some states do not allow certain limits, so they may not apply to you. If you are a New Jersey resident, Sections 11 and 12 apply to you only to the extent permitted by New Jersey law; in particular, Section 12 does not limit Torismic's liability for its gross negligence or reckless or willful misconduct.
13. Dispute Resolution; Arbitration; Class-Action Waiver
13.1 Informal resolution. Before starting arbitration, send a written notice with your name, account email, a description of the dispute, and the relief sought to support@torismic.com and 4343 North Rancho Drive, Suite 104, Las Vegas, Nevada 89130, or any updated address listed in Section 18. We will do the same. The parties will try to resolve the dispute for 60 days, including an individual telephone or video conference if requested. Any limitations period is tolled during this process.
13.2 Agreement to arbitrate. Except as provided in 13.5, any dispute between you and Torismic arising out of or relating to these Consumer Terms, the Program Terms, or the App will be resolved by binding individual arbitration administered by the AAA under its Consumer Arbitration Rules. The Federal Arbitration Act governs this Section. The arbitrator may award the same individual relief a court could award.
13.3 Fees and location. You pay only the consumer filing fee set by the AAA Consumer Rules. Torismic pays all other AAA administrative fees and arbitrator compensation above that filing fee, unless the arbitrator finds your claim frivolous or brought for an improper purpose. The arbitration will take place in the county where you live or by video/ documents, at your option.
13.4 Class-action and jury waiver. You and Torismic may bring claims only individually, not as a plaintiff or class member in any class, collective, or representative proceeding, and both waive a jury trial. If this waiver is found unenforceable as to a claim, that claim must be severed and heard in court, and the remainder arbitrated.
13.5 Exceptions. Either party may (a) bring an individual claim in small-claims court, or (b) seek injunctive relief in court for intellectual-property misuse. Claims for public injunctive relief (where such relief is available and non-waivable under applicable law, e.g., California) will be decided by a court after the individual claims are arbitrated.
13.6 Mass arbitration. If 25 or more similar demands are filed by the same or coordinated counsel, they will be administered under the AAA's Mass Arbitration Supplementary Rules, including batching, and fees will be assessed as those rules provide.
13.7 YOUR RIGHT TO OPT OUT WITHIN 30 DAYS. You may opt out of this arbitration agreement by sending notice to support@torismic.com or by mail to 4343 North Rancho Drive, Suite 104, Las Vegas, Nevada 89130 (or any updated address listed in Section 18), with your name and account email, within 30 days after first accepting these Consumer Terms. Opting out does not affect any other terms.
13.8 Changes. If we change this Section 13 materially, you may reject the change by notice within 30 days, and the prior version will apply to disputes between us.
14. Governing Law
These Consumer Terms are governed by Nevada law, except that the Federal Arbitration Act governs Section 13 and nothing here deprives you of protections of the consumer laws of your state of residence that cannot be waived by contract. Court proceedings (where permitted) will be in the state or federal courts of your county of residence or the state and federal courts located in Clark County, Nevada.
15. Changes to These Consumer Terms
Changes to these Consumer Terms. These Consumer Terms may change from time to time. When we change them, we will follow these steps: (1) Advance notice. We will send you notice by email (or another contact method on file for your account) at least 30 days before the change, stating the date the updated Consumer Terms take effect. (2) Acceptance. On that date, we will show you a pop-up or other notice in the App asking you to review and affirmatively accept the updated Consumer Terms (for example, by selecting “I accept”) before you continue using the App. If you do not accept the updated Consumer Terms within 30 days after we first show you that notice, Torismic may suspend or terminate your access to the App and your account. Changes required by law or to address fraud or security may take effect on shorter notice.
16. General
Force majeure, severability, no waiver, and assignment: we are not liable for failures caused by
events beyond our reasonable control; an unenforceable provision is enforced to the maximum extent
permitted and the rest remains effective; failure to enforce is not a waiver; you may not assign
these Consumer Terms, and we may assign them in connection with a merger, acquisition, or sale of
assets. You consent to electronic notices and agreements. These Consumer Terms, together with the
Torismic Rewards Program Terms (/rewards-terms) and the Privacy Policy (/privacy), constitute
the entire agreement between you and Torismic regarding the App and consumer features, and supersede
all prior or contemporaneous agreements and understandings, whether written or oral, relating to that
subject.
